1. About these Terms
These Terms of Service ("Terms") govern your use of the website at banqua.io and the trading services provided by Banqua Sp. z o.o., a company registered in Poland at Ul. Prezydenta Gabriela Narutowicza 40, 90-135, Łódź, Poland, KRS 0000979410 ("Banqua", "we", "us"). By opening an account or using our services, you agree to these Terms.
2. Eligibility
To open a Banqua account you must:
- Be at least 18 years old and have legal capacity to enter into a binding contract;
- Reside in a jurisdiction where Banqua offers services and where CFD trading is permitted;
- Not be a resident or citizen of, or located in, any jurisdiction subject to applicable sanctions or where our services are restricted (the current list is available on request);
- Complete our identity verification (KYC) and source-of-funds checks to our satisfaction.
We may refuse to open an account, suspend, or close an account at our discretion where required to comply with law or our risk policies.
3. The services we provide
Banqua provides a platform through which you can place orders for Contracts for Difference (CFDs) on crypto, foreign exchange, and commodity instruments. Orders are routed to and executed by regulated third-party partner brokers. Banqua is not a counterparty to your trades unless expressly stated.
We do not provide investment advice, tax advice, or personal recommendations. Any market information, research, or educational material we publish is for general information only and should not be relied on as the sole basis for any trading decision.
4. Your account
You are responsible for keeping your account credentials secure, enabling available security features (such as two-factor authentication), and notifying us immediately if you suspect unauthorised access. You are responsible for activity carried out under your account, except where caused by our gross negligence or wilful misconduct.
5. Deposits, withdrawals, and fees
Funded accounts must be in your own name. Third-party funding is not permitted. Withdrawals are returned to the source of the original deposit where possible. Fees, spreads, commissions, overnight financing, and any other charges are published on the platform and may be updated from time to time with reasonable notice.
6. Client money
Client funds are held in segregated accounts with regulated banking and brokerage partners and are not used to finance Banqua's own operations. Specific safeguards depend on the partner broker and jurisdiction — details are available in our risk disclosure and on request.
7. Order execution
Orders are sent to partner brokers for execution. We aim to obtain the best available result for you under our order-execution policy (available on request), but execution speed, price, and fill quality depend on market conditions and partner-broker systems. We do not guarantee that any order will be executed at a particular price or at all.
8. Risk disclosure
CFDs are leveraged products and carry a high risk of rapid loss. You can lose more than your initial deposit. You should read our full Risk Disclosure and only trade with capital you can afford to lose.
9. Prohibited use
You must not use Banqua to:
- Engage in market manipulation, abusive trading, or any activity prohibited by applicable law;
- Launder money, finance terrorism, or evade sanctions;
- Provide false information during onboarding or at any time;
- Use automated trading or third-party tools that we have not approved;
- Access the service through technical means designed to circumvent geographic or eligibility restrictions.
10. Intellectual property
The Banqua name, logo, website, platform, and all related content are owned by Banqua Sp. z o.o. or its licensors. You may use them only as needed to use the services. No other rights are granted.
11. Suspension and termination
We may suspend or close your account, freeze positions, or refuse transactions where we reasonably believe you are in breach of these Terms, where we are required to by law, or where doing so is necessary to protect Banqua, our other clients, or our partner brokers. You can close your account at any time after settling any open positions and balances.
12. Liability
To the maximum extent permitted by law, Banqua is not liable for indirect, consequential, or incidental losses; lost profits; or losses arising from market movements, third-party failures, or events beyond our reasonable control. Nothing in these Terms limits our liability for fraud, wilful misconduct, or any liability that cannot be limited by law.
13. Complaints
If you have a complaint, contact us at office@banqua.io. We will acknowledge your complaint within 5 business days and provide a final response within the period required by applicable law. If you are not satisfied, you may refer the matter to the relevant regulator or alternative dispute resolution body in your jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified to you through the platform or by email. Continued use of the services after the effective date of the change constitutes acceptance.
15. Governing law and jurisdiction
These Terms are governed by the laws of Poland. Disputes shall be resolved by the competent courts of Poland, without prejudice to mandatory consumer-protection rights you may have under the law of your country of residence.
